General Terms and Conditions
these general terms and conditions apply to all offers, orders, agreements, deliveries, and services of duvet beds.
1. definitions
- duvet beds: the company operating under the name duvet beds.
- customer: any natural or legal person who enters into an agreement with duvet beds.
- products: all goods offered by duvet beds, including duvets, beds, mattresses, and related items.
2. applicability
- these general terms and conditions apply exclusively to all legal relationships between duvet beds and the customer.
- deviations are only valid if confirmed in writing by duvet beds.
- the customer's general terms and conditions are expressly rejected.
3. offers and agreements
- all offers from duvet beds are without obligation.
- obvious errors, pricing errors, typesetting errors, or mistakes do not bind duvet beds.
- an agreement is only concluded after written confirmation or execution by duvet beds.
4. prices and payments
- all stated prices include VAT unless otherwise indicated.
- duvet beds reserves the right to change prices in the interim.
- payment must be made in full in advance unless otherwise agreed in writing.
- in case of late payment, the customer is immediately in default without prior notice of default.
- all judicial and extrajudicial collection costs are entirely at the expense of the customer.
5. delivery
- stated delivery times are indicative and do not constitute a strict deadline.
- delay in delivery does not entitle the customer to compensation.
- duvet beds has the right to make partial deliveries.
- the customer is responsible for correct accessibility of the delivery location.
- additional costs due to insufficient access or incorrect information will be borne by the customer.
6. retention of title
- all delivered products remain the property of duvet beds until full payment has been made.
- the customer is not authorized to pledge, alienate, or resell products before full payment.
7. right of withdrawal and returns
- consumers have the right to withdraw from the agreement within 14 days of receipt without stating reasons, unless there is custom work or a legal exception.
- specially manufactured, personalized, or custom-made products are excluded from return and withdrawal.
- returns must be returned unused, undamaged, and in their original packaging.
- depreciation due to use will be borne by the customer.
- return costs are at the expense of the customer unless otherwise agreed in writing.
8. cancellations
- cancellations are only valid after written approval from duvet beds.
- duvet beds reserves the right to fully charge cancellation costs and already incurred costs.
9. warranty and complaints
- only the statutory warranty applies.
- normal wear and tear, improper use, moisture, improper maintenance, assembly errors, or damage are not covered by the warranty.
- minor deviations in color, structure, finish, fabric, dimensions, or comfort do not constitute a defect.
- complaints must be reported in writing within a reasonable time after discovery.
- the customer must inspect products immediately upon delivery.
10. liability
- duvet beds is only liable for direct damage caused by intent or deliberate recklessness.
- any liability is limited to the amount paid out by the insurer, or the invoice amount of the relevant order.
- duvet beds is never liable for indirect damage, consequential damage, loss of profit, emotional damage, or missed savings.
- the customer indemnifies duvet beds against third-party claims.
- any claim expires one year after delivery.
11. force majeure
- force majeure also includes: malfunctions, war, pandemics, cyber attacks, transport problems, import restrictions, strikes, government measures, energy disruptions, and shortcomings of suppliers.
- during force majeure, obligations may be suspended without compensation.
- duvet beds has the right to dissolve agreements in whole or in part if force majeure continues for longer than 30 days.
12. intellectual property
- all images, designs, texts, product photos, logos, and other content remain the property of duvet beds.
- use, reproduction, or distribution without written permission is prohibited.
13. privacy
- duvet beds processes personal data in accordance with applicable privacy legislation.
- personal data may be used for customer service, order processing, and marketing purposes in accordance with the privacy policy.
14. applicable law and competent court
- all agreements are exclusively governed by dutch law.
- disputes will be exclusively submitted to the competent court in the netherlands.
